General Terms and Conditions
- GeneralThis General Terms and Conditions (GTC) apply to all services and products provided by Skilifte Kalte Herberge (hereinafter referred to as “contractual partner”).
- ContractBy purchasing a lift ticket or service, or by using such a service, a contract is formed with Skilifte Kalte Herberge.
- Identification RequirementThe customer must present valid identification (e.g., passport, lift ticket) when using personalized tickets upon request by the contractual partner’s staff.
- Lift TicketThe lift ticket grants access to the ski lift and conveyor belts. It is only valid on the day of purchase and during the specified time. No refunds are provided for damage or loss.
- Data ProtectionDetails on data protection are explained in the Skilifte Kalte Herberge’s Data Protection Declaration.
- Lift Ticket and Proof of EligibilityAll lift tickets are personal and non-transferable.
- ValidityLift tickets are valid at the ski lift and conveyor belts (as per notice/display on the lift ticket). If the tickets are time-based, they are valid for the designated period. Please note that the operation of the ski lifts only occurs during the published operating hours (including special operating hours) of Skilifte Kalte Herberge. Outside of these hours, there is no right to use the lift facilities.
- Age GroupsDifferent fare groups apply. The fare groups and respective prices can be found in the fare schedules provided as posters or online. Errors are reserved.
- Webcam and Video RecordingsWebcams are installed at the ski lift and conveyor belts. These webcams capture the surrounding area (e.g., the environment of the mountain station, slope, ski lift) in real-time and without sound. The images are available on various websites to give guests and interested parties an up-to-date impression of the weather and conditions. Although these webcams cover a wide area and individuals are difficult to identify, it cannot be excluded that webcams may capture image data as personal data. Where and to the extent personal data are processed, this is based on the legitimate interest of the controllers, which is to provide potential customers with an overview of current weather conditions and other factors significant for deciding whether to use the offer. The lift facilities, conveyor belts, entry, and exit areas are monitored by video by the controllers. The purpose of processing these video data is to monitor areas under the controllers’ right of access or to monitor the facilities to manage or detect disruptions. The legal basis for processing these video data is the controllers’ legitimate interest in achieving these purposes. Video data from surveillance is stored for 24 hours. If longer storage is necessary to secure the purposes pursued with recording and storage of the images, it will be done on a case-by-case basis. In any case, data will be deleted when storage is no longer necessary for the stated purposes.
- ServicesThe services provided by the contractual partner are specified in the descriptions in electronic media, at ticket office displays, and in other written offers.
- PricesThe prices for lift tickets are published online. Unless otherwise stated, the lift ticket prices are per person and include VAT. All tickets are personal and non-transferable.
- PaymentPayment is due upon issuing the lift ticket and occurs immediately at contract conclusion. Lift tickets are generally not available on account.
- CurrencyPrices are quoted in euros. Other currencies are not accepted.
- Refunds
- AccidentIf the ticket holder cannot use the ticket due to an accident, there is no refund for unused time.
- Lost/Damaged TicketNo replacement entitlement exists for lost or damaged lift tickets.
- Ticket MisuseStaff of the contractual partner are entitled to check lift tickets at any time. Any misuse of lift tickets, especially transfer of ski passes or alteration of their information, will result in immediate confiscation of the ticket. The contractual partner reserves the right to take legal action. A passenger is obliged to pay an increased fare if they:
- do not have a valid lift ticket.
- have a valid ticket but cannot present it upon inspection.
- exceed the validity area of the ticket.
- do not present the ticket for inspection upon request.
- use a ticket unlawfully or are found with a forged ticket.
- Service DisruptionsOperating restrictions or shutdowns due to force majeure, such as wind and weather influences, avalanche danger, strikes, official orders, operational disruptions (e.g., due to technical defects or power outages), do not entitle the user to refunds or compensation if they are beyond the management’s control.
- Wildlife and Forest Protection ZonesThere are increased risks for variant, ski, and snowboarders off marked and controlled slopes. The contractual partner’s slopes are situated in open terrain.
- Reckless Behavior/Customer MisconductIn cases of reckless behavior, breach of these terms, or disregard of staff instructions, especially non-compliance with FIS rules, signals, instructions, and barriers, or skiing on closed slopes or wildlife and forest protection zones, the contractual partner or its affiliates may revoke the ticket holder’s lift ticket. Slopes are closed outside official operating hours, and skiing is prohibited. Those endangering safety and order in the winter sports area due to drunkenness or drug abuse may be temporarily or permanently banned from using the lifts and winter sports slopes. Ticket prices will not be refunded. Willful damage or pollution of the facility will be pursued, with criminal charges reserved in cases of intentional damage/pollution.
- FIS RulesThe 10 FIS rules apply to all snow sports equipment (source www.fis-ski.com):
- Respect for other skiers and snowboarders. Every skier and snowboarder must behave in a way that does not endanger or harm others.
- Control of speed and skiing style. Every skier and snowboarder must ski within sight and adjust speed and skiing style according to their ability, terrain, snow and weather conditions, and traffic density.
- Choice of path. The skier or snowboarder coming from behind must choose their path so as not to endanger those skiing ahead.
- Overtaking. Overtaking may be done from above or below, from the right or left, but always with enough space to allow the overtaken skier or snowboarder freedom of movement.
- Entering, starting, and skiing uphill. Any skier or snowboarder entering a slope, starting after a stop, or intending to turn uphill must check that they can do so without endangering themselves or others.
- Stopping. Skiers and snowboarders should avoid stopping unnecessarily in narrow or blind spots on a slope. Fallen skiers or snowboarders must clear such spots as quickly as possible.
- Climbing and descending. A skier or snowboarder climbing or descending on foot must use the edge of the slope.
- Observing signs. Every skier and snowboarder must follow markings and signals.
- Providing assistance. In case of an accident, every skier and snowboarder is required to assist.
- Identification requirement. Every skier and snowboarder, whether witness or participant, responsible or not, must provide their identification in the event of an accident.
- Complaints, LiabilityThe contractual partner is liable for personal and property damages caused by them or their staff in accordance with the following provisions. The contractual partner is generally not liable for personal and property damages, especially not for damages from accidents resulting from disregard of instructions, such as:
- Disregard of markings and information boards, leaving secured and controlled slopes
- Disregard of instructions and warnings from lift personnel or piste and rescue services
- Engaging in risky sports
- Vouchers
- Contract ConclusionVouchers offered on www.skilifte-kalte-herberge.de are non-binding sales offers.
- PaymentThe stated prices for lift tickets are in euros, including VAT. The purchase of a lift ticket constitutes a binding contract. Upon receipt of the payment due under the purchase contract, the vouchers are sent to the customer by mail. No liability is accepted for postal delays unless caused by the contractual partner. The minimum value of a voucher is €10. Vouchers can only be redeemed for purchasing lift tickets.
- VouchersVouchers are sent to customers with a voucher number. Only the original voucher is redeemable. Copies or forgeries hold no value. If additional copies with the same voucher number appear, it constitutes misuse, which may lead to criminal consequences. Since a voucher can be transferred or gifted, the contractual partner is not required to verify the possessor’s ownership. Lost vouchers are not replaced. Vouchers cannot be exchanged for cash. If the voucher’s value exceeds the consumed service, a new voucher with the remaining value is issued. In such cases, no claim to a cash payout of the remaining voucher amount exists.
- Validity PeriodThe voucher can only be redeemed for lift ticket purchases within three years. This three-year period begins at the end of the year in which the voucher was purchased.
- Final ProvisionAll contracts concluded under these GTC with the contractual partner are exclusively subject to German law. Status November 2024, subject to change
